1. Acceptance of Terms

By accessing or using the services of Zion FM Logistics and Zion Kenan Logistics Nig. Limited (collectively "Company", "We", "Us", "Our"), you agree to be bound by these Terms of Service. These terms apply to all shipping, clearing, forwarding, warehousing, and logistics services provided by our company from China to Nigeria and domestic operations within Nigeria.

These Terms constitute a legally binding agreement between you ("Customer," "Shipper," "Consignee," "You") and Zion FM Logistics. We reserve the right to modify these Terms at any time. Continued use of our Services after changes constitutes acceptance of the modified Terms.

2. Services Provided

Zion FM Logistics provides comprehensive logistics and freight services including:

  • China to Nigeria Shipping: Full container load (FCL) and less than container load (LCL) services
  • Clearing and Forwarding: Customs clearance, documentation, and delivery
  • Compressing Services: Volume reduction for groupage cargo
  • Warehousing: Storage facilities in Onitsha, Aba, and Nnewi
  • Real-time Shipment Tracking
  • Personal & Groupage Container Consolidation

3. User Accounts & Registration

To use certain features, you must register an account. You agree to provide accurate information including full name, valid phone number, and email address. You are responsible for all activities under your account.

4. Shipping & Delivery Terms

4.1 Shipping Estimates

Delivery estimates are provided as guidance only. Actual delivery times vary due to customs clearance, weather, port congestion, and other factors beyond our control. Standard China-to-Nigeria transit: 50-75 business days.

4.2 Packaging Requirements

Shippers must ensure proper packaging. The Company is not responsible for damage caused by inadequate packaging. Fragile items must be clearly marked.

4.3 Goods Inspection

IMPORTANT: All goods must be checked before leaving our warehouse. After goods leave our warehouse, we assume no responsibility for condition, quantity, or damage. Customers must verify their shipment at point of collection.

4.4 Undeliverable Packages

Storage fees may apply for packages not collected within 7 days of arrival notification. After 30 days, unclaimed goods may be disposed of or auctioned to cover storage and handling costs.

5. Payment & Fees

5.1 Fee Structure

Freight and clearing costs are borne by the agent/shipper and paid by the consignee/importer before goods are released. No goods will be released without full payment.

5.2 Additional Charges

Customers are responsible for:

  • Customs duties and taxes assessed by Nigerian Customs Service
  • Demurrage and port storage fees (if applicable)
  • Re-delivery fees for address corrections
  • Storage fees beyond free storage period

5.3 Currency

All fees for China-to-Nigeria shipments are quoted in USD or Naira at prevailing exchange rates. Domestic Nigeria transactions are in Naira (₦).

6. Cancellations, Refunds & Claims

6.1 Cancellation Policy

Shipment cancellations must be requested before goods are loaded for export. Cancellations after loading may incur partial charges.

6.2 Claim Procedure

Claims for loss or damage must be filed within 7 days of delivery or expected delivery date. Claims require:

  • Photographic evidence of damage
  • Original packing list and invoice
  • Tracking number and container number
Notice: We are not responsible for copy goods, samples, or items seized by customs or government authorities. Such seizures are at the shipper's/consignee's sole risk.

7. Liability & Force Majeure

7.1 Limitation of Liability

Our liability for loss or damage is limited to the actual value of goods up to a maximum of $100 per shipment or ₦50,000, whichever is lower, unless additional insurance is purchased.

7.2 Force Majeure

We are not liable for delays or failures caused by:

  • Fire, flood, typhoon, earthquake, or natural disasters
  • War, terrorism, civil unrest, or strikes
  • Government actions, customs seizures, or regulatory changes
  • Natural loss, inherent defects, or deterioration of goods
  • Port congestion, shipping line schedule changes

7.3 Insurance

Cargo insurance is available upon request at additional cost. Customers are strongly advised to insure high-value shipments.

8. Prohibited & Restricted Items (Complete List)

The following items are strictly PROHIBITED from shipment. Violation may result in seizure, legal action, permanent ban, and reporting to relevant authorities:

1. Arms & Weapons

Arms, simulation weapons, ammunition, controlled knives, explosive articles, any form of weaponry

2. Flammable & Explosive Materials

Inflammable articles, explosive articles, oxidizing agents, peroxides, fireworks, gasoline, lighter fluid

3. Narcotics & Psychoactive Drugs

Narcotic drugs, drug taking tools, stupefacient/psychoactive drugs (improper use), precursor chemicals, toxic substances (improper use)

4. Biological & Chemical Hazards

Biochemical, epidemic and infectious materials, radioactive substances, hazardous chemicals

5. Counterfeit Currency & Securities

Illegal counterfeit products, counterfeit/altered currency, marketable securities, certificates, official seals, stamps

6. Intellectual Property Infringement

Articles infringing intellectual property rights; counterfeit and shoddy products; pirated goods

7. Animals & Endangered Species

Animals, plants (especially endangered species and their products), animal hides, ivory, protected flora/fauna

8. Hazardous Food & Drugs

Food, drugs, or articles hazardous to human/animal health that may spread disease from infected areas; unapproved pharmaceuticals

9. Tobacco & Alcohol Products

Cigarettes, tobacco, tobacco products, liquor, alcoholic beverages (restricted - special permit required)

10. Valuable Articles

Artworks, antiques, gems, precious metals including gold, silver, platinum; jewelry; rare coins; collectibles (shipper bears all risk)

11. Electronic Waste

E-waste, used electronics without proper certification, non-functional electronic equipment

12. Cultural Artifacts

National treasures, cultural artifacts, archaeological findings (requires special export/import permits)

13. Batteries

All types of batteries including lithium, alkaline, lead-acid, rechargeable, and battery-powered devices. We DO NOT carry batteries of any kind.

8.2 Items Subject to Rejection or Additional Scrutiny

We reserve the right to reject or temporarily stop mailing packages that:

  • Lack detailed shipper/receiver contact information (full names, addresses, phone numbers)
  • Have improper packaging, labeling, or lack required certificates
  • May endanger transport vehicles or personnel safety
  • Are not suitable for mailing from economic or operational perspective
  • Contain fragile items not properly marked or packaged
  • Have incomplete or inaccurate customs documentation
  • Exceed weight or size limits for standard shipping
  • Require special handling or temperature control without prior arrangement
Legal Notice: Shipment of prohibited items violates Nigerian law, Anambra State regulations, and our terms. Offenders will be reported to appropriate authorities including NDLEA, Nigerian Customs Service, and Nigeria Police Force. The owner/importer bears all risks for illegal, counterfeit, inflammable/explosive, fragile, or toxic goods. Seized items will not be compensated.

9. Privacy & Data Protection

We collect and process personal information including names, addresses, phone numbers, and identification documents for shipping and customs clearance purposes. Your information is protected in accordance with the Nigeria Data Protection Regulation (NDPR) 2019. We do not sell or share your data with third parties except as required for shipping operations or by law.

10. Governing Law & Jurisdiction

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Anambra State, Nigeria.

Jurisdiction: Any disputes arising under or in connection with these Terms shall be resolved exclusively in the courts located in Onitsha, Anambra State, Nigeria. The parties hereby submit to the exclusive jurisdiction of the courts of Anambra State.

Alternative Dispute Resolution: Before initiating legal proceedings, parties agree to attempt good-faith mediation to resolve any disputes.

Dispute Resolution: Any claim arising from these Terms shall be filed within one (1) year of the cause of action. The prevailing party may be entitled to recover reasonable attorney fees and costs as determined by the court. All proceedings shall be conducted in English.

11. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, including shipment of prohibited items, non-payment, or fraudulent activity. Upon termination, all outstanding fees become immediately due. Termination does not affect any rights or obligations that accrued before termination.
